Today, AIDS is the leading cause of death in developing countries. Its baneful force is fueled by a wide pasture of human rights violations. This paper argues that one of the existential realities of being an human immunodeficiency virus positive is the violation of human rights. A human right based approach is needed to fight with HIV/AIDS.
In the absence of specific legislation in this regard, Indian court has rightly considered the rights of these people giving protection in the dizzy of human rights dimension. This approach starts from the premise that human rights abuses contribute to the string out of HIV and undermine attempts to protect people from becoming infected, an at once infected, from receiving needed treatment and care. With the hypothesis that, Indian Judiciary has also played an important role towards the protection and recognition of human rights of persons suffering from HIV/AIDS.
